    These Terms & Conditions ("Terms") govern access to and use of the Moby platform, software, websites, applications, chat interfaces, Walkie Talkie feature, dashboards, and related services (collectively, the "Services") operated by Moby, Inc. ("Moby," "we," "us," or "our").

    By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

    For purposes of these Terms:

    • "Client" means any individual or entity that licenses, deploys, or uses Moby in connection with their business, organization, property, facility, website, or services, including but not limited to property managers, hospitality providers, clinics, tourism boards, municipalities, educational institutions, and other organizations.
    • "End User" means any individual who interacts with Moby through chat, voice, QR code, NFC tag, website widget, kiosk, or any other interface, whether on-site or remotely.
    • "Services" means the Moby platform, AI-powered assistant, chat interface, Walkie Talkie feature, dashboards, and related tools.
  4. 4. Acceptance of Terms

    By clicking "Accept," accessing, or interacting with Moby in any manner, including through chat or Walkie Talkie, you acknowledge that you have read, understood, and agree to these Terms and the Privacy Policy.

  5. 5. Description of Services

    Moby is a software-as-a-service platform that provides automated, AI-powered informational responses on behalf of Clients.

    Moby:

    • Is not a property owner, operator, service provider, or authority
    • Acts solely as a software platform
    • Does not make decisions for End Users
    • Does not provide professional advice
  6. 6. Informational Use Only

    All responses provided by Moby are for general informational purposes only.

    Moby does not provide medical, legal, safety, travel, financial, or professional advice. Responses may be incomplete, outdated, or inaccurate.

    End Users must use their own judgment and verify critical information independently. For urgent, official, or professional matters, End Users must contact the Client directly or consult appropriate professionals or authorities.

  7. 7. Client Responsibility

    Clients are solely responsible for:

    • The accuracy, legality, and appropriateness of information provided through Moby
    • Their operations, services, facilities, and compliance with applicable laws
    • Any instructions, guidance, or content delivered to End Users via Moby

    Moby is not responsible for Client-provided content or instructions.

  8. 8. No Warranties

    The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied.

    Moby expressly disclaims all warranties, including but not limited to:

    • Accuracy or reliability of responses
    • Fitness for a particular purpose
    • Availability or uninterrupted operation
  9. 9. Limitation of Liability

    To the maximum extent permitted by law:

    Moby shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to personal injury, property damage, loss of data, loss of revenue, or business interruption.

    In no event shall Moby's total liability exceed the amount paid to Moby by the applicable Client in the twelve months preceding the claim.

  10. 10. End User Responsibility

    End Users acknowledge and agree that:

    • They use the Services at their own discretion and risk
    • They remain solely responsible for their actions
    • They must verify information before acting upon it
  11. 11. Prohibited Use

    You agree not to:

    • Misuse or interfere with the Services
    • Attempt to reverse engineer or exploit the platform
    • Use Moby for unlawful, harmful, or misleading purposes
    • Rely on Moby as a substitute for professional advice
  12. 12. Intellectual Property

    All software, content, trademarks, and intellectual property associated with Moby are owned by or licensed to Moby, Inc.

    No rights are granted except as expressly stated in these Terms.

  13. 13. Termination

    Moby may suspend or terminate access to the Services at any time, with or without notice, for misuse, security reasons, or legal compliance.

  14. 14. Privacy

    Use of the Services is subject to the Moby Privacy Policy, which explains how personal data is collected and processed.

  15. 15. Governing Law and Jurisdiction

    These Terms are governed by the laws of the jurisdiction in which the applicable Client's operations are located, without regard to conflict-of-law principles.

  16. 16. Changes to Terms

    Moby may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.

  17. 17. Severability

    If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

  18. 18. Entire Agreement

    These Terms constitute the entire agreement between you and Moby regarding the Services and supersede any prior agreements or understandings.
